Terms of Service
These terms describe how EleWave may be used, what customers are responsible for, and how the service is provided.

1. Who provides EleWave
EleWave is provided by elewave work B.V., registered in the Netherlands with the Dutch Chamber of Commerce under KvK: 99680521.

2. Agreement to these terms
By accessing or using EleWave, you agree to these Terms of Service. If you use EleWave for an organization, you confirm that you are authorized to accept these terms on behalf of that organization.
If a signed agreement between you and elewave work B.V. conflicts with these terms, the signed agreement controls for that conflict.
3. The service
EleWave helps customers turn processes, training, checklists, approvals, and member journeys into scheduled activities assigned to the right people, delivered at the right time, and tracked with completion records.
We may improve, change, add, or remove features as the product develops.
4. Accounts and workspaces
You are responsible for keeping account credentials secure and for all activity that happens under your account or workspace. You must provide accurate account and billing information and keep it up to date.
Workspace owners are responsible for configuring members, roles, assignments, integrations, schedules, activity content, and retention practices for their own workspace.
5. Customer content and data
You keep ownership of the content, data, files, responses, proof submissions, and activity records you submit to EleWave.
You grant EleWave the rights needed to host, process, transmit, display, and store that content so we can provide the service. You are responsible for making sure you have the rights and permissions needed to submit the content and personal data you place in EleWave.
6. Acceptable use
You must not use EleWave to:
- break the law or violate someone else's rights;
- send spam, phishing, malware, or deceptive content;
- upload unlawful, harmful, or infringing material;
- attempt to bypass security, access controls, rate limits, or workspace boundaries;
- interfere with the reliability or integrity of the service;
- use EleWave for high-risk activity where failure could cause death, personal injury, or severe physical or environmental damage.
7. Integrations and third-party services
EleWave may connect with third-party services such as Slack, Microsoft Teams, WhatsApp, email providers, billing providers, analytics tools, and hosting infrastructure. Your use of those services may be governed by their own terms and privacy policies.
You are responsible for configuring integrations correctly and for the data you choose to send through them.
8. Fees and payment
Paid plans, invoices, taxes, renewals, and payment terms are described during purchase, in the product, or in a separate order form. Unless otherwise agreed, fees are non-refundable except where required by law.
If payment is overdue, we may suspend or limit access after reasonable notice.
9. Confidentiality and security
Each party may receive confidential information from the other. The receiving party must use reasonable care to protect confidential information and may only use it for the purpose of providing or using EleWave.
We use reasonable technical and organizational measures designed to protect the service, but you are responsible for securely managing your users, integrations, access permissions, and workspace configuration.
10. Availability and support
We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free availability. Maintenance, incidents, third-party outages, or changes in connected services may affect availability.
Support channels and response expectations may depend on your plan or signed agreement.
11. Suspension and termination
You may stop using EleWave at any time. We may suspend or terminate access if you breach these terms, create security or legal risk, fail to pay amounts due, or use the service in a way that may harm EleWave, other customers, or third parties.
After termination, access to the service may stop and customer data may be deleted after a reasonable retention period unless we are legally required or contractually permitted to retain it.
12. Intellectual property
EleWave, including the software, design, brand, workflows, documentation, and underlying technology, belongs to elewave work B.V. or its licensors.
These terms do not grant you ownership of EleWave. They grant you a limited right to use the service according to these terms and any applicable plan or agreement.
13. Disclaimers
EleWave is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not promise that the service will meet every requirement, be uninterrupted, or be free from errors.
AI-assisted features, if used, may help draft content, summaries, proposals, or suggestions. You remain responsible for reviewing and approving output before using it in operational, legal, compliance, or customer-facing contexts.
14. Liability
To the maximum extent permitted by law, elewave work B.V. is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities.
Any liability that cannot be excluded will be limited to the amount paid for EleWave during the twelve months before the event giving rise to the claim, unless a different limit is required by law or agreed in writing.
15. Changes to these terms
We may update these terms from time to time. If changes are material, we will provide reasonable notice where appropriate. The updated date on this page shows when the terms were last changed.
16. Governing law
These terms are governed by the laws of the Netherlands, unless mandatory law says otherwise.
Any dispute will be handled by the competent courts in the Netherlands, unless mandatory law requires another venue.
